नियम 101 के अनुसार राज्य सरकार विशेष असमर्थता अवकाश ऐसे सिविल सेवक को भी स्वीकृत कर सकती है जो मिलिटरी फोर्स के साथ अपनी राजकीय सेवा के परिणामस्वरूप असमर्थ (Disabled) हो गये हों व इस कारण पदमुक्त (Discharged) नहीं किये गये हो मगर ऐसी असमर्थता से पीड़ित हो जो सैनिक सेवा में रहने का कारण हुई हो।
इस प्रकार के अवकाश की स्वीकृति निम्नांकित शर्तों पर दी जावेगी:
1. यदि बीमारी के कारण असमर्थता हुई हो तो चिकित्सा मण्डल द्वारा यह प्रमाणित किया जाना चाहिये कि वह बीमारी किसी विशिष्ट सेवा के फलस्वरूप हुई है।
2 चिकित्सा-मण्डल द्वारा जितने समय के लिये पद से अनपस्थित रहने की सिफारिश की जावे उस अवधि में इस नियम के अंतर्गत देय असमर्थता अवकाश तथा शेष अवधि को दूसरे अवकाशों से पूरा
Application of special disability leave rules to Civil Servants. —The provisions of this section apply to a Civil servant disabled in consequence of service with military force, if he is discharged as unfit for further military service, but is not completely and permanently incapacitated for further civil service, and to a civil servant not so discharged who suffers a disability which is certified by a Medical Board to be directly attributable to his service with a military force; but in either case, any period of leave granted to such a person under military rules in respect of that disability shall be reckoned as leave granted under this rule for the purpose of calculating the period admissible.
102. Government may extend the application of the provisions of this section to a Government servant who is disabled by injury accidentally incurred in or in consequence of the due performance of his official duties or in consequence of his official position, or by illness incurred in the performance of any particular duty which has the effect of increasing his liability to illness or injury beyond the ordinary risk attaching to the civil post which he holds. The grant of this concession is subject to the further conditions: — (i) that the disability, if due to disease, must be certified by a Medical Board to be directly due to the performance of the particular duty; and (ii) that, if the Government servant has contracted such disability during service, otherwise than with a military force, it must be, in the opinion of the Government so exceptional in character, or in the circumstances of its occurrence as to justify such unusual treatment as the grant of this form of leave; and (iii) that the period of absence recommended by the Medical Board may be covered in part, by leave under this rule and in part by other leave, and that the amount of special disability leave granted on average pay may be less than 120 or 60 days according as the service is Superior or Class IV.
