पुन: प्रस्थापन अथवा बहालगी (Re-instatement) पर वेतन


पुन: प्रस्थापन अथवा बहालगी (Re-instatement) पर वेतन: नियम 54(1) के अनुसार जब एक राज्य कर्मचारी, जिसे सेवा से निष्काशित अथवा बर्खास्त कर दिया हो या अनिवार्य रूप से सेवा  निवृत कर दिया गया हो या निलम्बित किया हुआ हो और वह आगे चलकर किसी अपील अथवा पुनरावलोकन आदि के कारण सेवा में पुन: प्रस्थापित हो जाता है अथवा उसे निलम्बन से बहाल कर दिया जाता है तो ऐसी स्थिति में पनः प्रस्थापन के आदेश देने वाले सक्षम अधिकारी को निम्न अंकित बिन्दुओं पर विचार कर विशिष्ट आदेश देने चाहिये :

1. नियम 54(1)(a) के अनुसार कर्त्तव्यों से अनुपस्थिति अथवा विश्रामवृत्ति की आयु पर सेवा-निवृत्त किये जाने की तारीख तक ही निलम्बन की अवधि में कर्मचारी को क्या वेतन एवं भत्ते आदि दिये जायें।

2. नियम 54(1)(b) के अनुसार क्या उक्त अवधि "कर्त्तव्य पर बिताई गई अवधि' (On-duty) मानी जावेगी या नहीं।

3. नियम 54(2) के अनुसार जहाँ प्राधिकारी को यह ज्ञात हो जाये कि कर्मचारी को पूर्णतया दोषमुक्त कर दिया गया है अथवा निलम्बित किया जाना पूर्णतया औचित्यहीन था तो ऐसे कर्मचारी को उस अवधि में उसी दर पर वेतन एवं महंगाई भत्ते आदि दिये जाने चाहिये जो वह सेवा से निलम्बित/निष्कासित अथवा अनिवार्य रूप से सेवानिवृत्त नहीं किया जाता तो प्राप्त करता। ऐसे मामलों में माना जाता है कि कर्मचारी के विरूद्ध किसी प्रकार के निलम्बन आदेश जारी ही नहीं हुये। नियम 54(4) के अनुसार ऐसे मामलों में कर्त्तव्यों से अनुपस्थिति के समय को सभी कार्यो के लिये कर्त्तव्य पर व्यतीत किया समय के रूप में माना जायेगा।

4. नियम 54(3) के अनुसार अन्य मामलों में ऐसे कर्मचारी को वेतन एवं महंगाई भत्ते का ऐसा भाग दिया जावेगा जो सक्षम प्राधिकारी अपने आदेशों द्वारा निर्धारित करें।

5. नियम 54(5) के अनुसार ऐसे मामलों में कर्त्तव्य से अनुपस्थिति अवधि को कर्त्तव्य पर व्यतीत अवधि के रूप में जब तक नहीं समझा जावेगा जब तक सक्षम प्राधिकारी विशेष रूप से उस अवधि को ऐसा समझने के स्पष्ट आदेश जारी नहीं कर दे किन्तु यदि कर्मचारी ऐसा चाहे तो सक्षम प्राधिकारी ऐसे निर्देश जारी कर सकता है कि सेवा में अनुपस्थिति की अवधि कर्मचारी के बकाया एवं स्वीकृत किये जाने योग्य किसी भी प्रकार के अवकाशों में परिवर्तित की जायेगी। यहां यह अंकित करना उचित होगा कि इस प्रावधान के तहत कर्त्तव्य से अनुपस्थिति की अवधि मानने का सक्षम प्राधिकारी का आदेश पूर्णतया मान्य है। अस्थायी कर्मचारी को 3 माह से अधिक के असाधारण अवकाश की स्वीकृति के लिये उसे किसी उच्च स्वीकृति की आवश्यकता नहीं है।

6. नियम 54(6) के अनुसार कई बार ऐसा भी होता है कि दण्डाज्ञा में यह उल्लेख नहीं होता कि निलम्बन की अवधि पेंशन के प्रयोजनार्थ गिनी जायेगी या नहीं, वहां निलम्बन की अवधि पेंशन के प्रयोजनार्थ गिनी जायेगी। बाकी सभी अन्य मामलों में, दण्डाज्ञा के अनुसार कार्यवाही की जायेगी।

नियम 54(7) के नीचे दी गयी टिप्पणी संख्या 1 के अनुसार  पुनरावलोकन एवं अपील पर वेतन आदि का भुगतान : पुनरावलोकन एवं अपील सुनने के लिये सक्षम प्राधिकारी एक कर्मचारी द्वारा निलम्बन काल में व्यतीत समय को, उसे निलम्बित किये जाने से पूर्व देय अवकाशों में परिवर्तित करने एवं उसके एवज में अवकाश वेतन भुगतान के आदेश दे सकता है।

 

नियम 54(7) के नीचे दी गयी टिप्पणी संख्या 2 के अनुसार सेवा से बर्खास्त/निष्कासित कर्मचारी जब अपील करने पर किसी तारीख से पुनः प्रस्थापित कर दिया जाता है तथा अपील के आदेशों में बर्खास्तगी/निष्कासन की तारीख एवं पुनः प्रस्थापना की तारीख के बीच की अवधि को 'कर्त्तव्य के रूप में व्यतीत अवधि' मानने का आदेश

दिया जाता है तथा उस समय को अवकाश एवं वेतन वृद्धि के लिये सम्मिलित करने की स्वीकृति दी जाती है तो ऐसे आदेशों को सक्षम आदेश मानकर पालना करनी चाहिये, चाहे उस कर्मचारी द्वारा उस अवधि में किसी स्थायी पद पर कोई पदाधिकार नहीं रखा हो क्योंकि ऐसे कर्मचारी द्वारा रिक्त किये गये पद को इसी शर्त के साथ भरा जा सकता है कि यदि निष्कासित कर्मचारी अपील के कारण पुनः प्रस्थापित कर दिया जावेगा तो उस पद पर किये गये प्रबंध समाप्त हो जावेंगे।

 

नियम 54(7) के नीचे दी गयी टिप्पणी संख्या 3 के अनुसार निलम्बन काल की किसी अवधि को सक्षम प्राधिकारी द्वारा जब असाधारण अवकाशों में परिवर्तित करने के आदेश दे दिये जा सकते है। ऐसे आदेश जारी होने पर कर्मचारी के निलम्बन के कलंक तथा उसके अनुसरण में होने वाले समस्त विपरीत परिणाम समाप्त हो जाते हैं। जिस समय निलम्बन अवधि अवकाशों में बदल दी जाये तो उसी समय यह निलम्बन आज्ञा को प्रभावहीन कर देता है तथा वह समय निलम्बन काल में बिताया हुआ समय बिल्कुल नहीं माना जायेगा। ऐसी स्थिति में जब यह ज्ञात हो जाय कि एक कर्मचारी निलम्बन की अवधि में निर्वाह अनुदान एवं क्षतिपूरक भत्ते आदि जो राशि कुल भुगतान के रूप में प्राप्त करता है यदि यह अवकाश वेतन एवं उन पर देय भत्तों से अधिक बनती हो तो ऐसी अधिक राशि कर्मचारी से वसूल की जावेगी तथा इस परिणाम से बचने का कोई उपाय नहीं है।

नियम 54(7) के नीचे दी गयी टिप्पणी संख्या 5 के अनुसार जब एक कर्मचारी को अनिवार्य रूप से सेवा-निवृत्त कर दिया जावे अथवा सेवा से निष्कासित कर दिया जावे तो उसके परिणामस्वरूप उस रिक्त पद को एक वर्ष तक नहीं भरा जाना चाहिए। एक वर्ष की समाप्ति पर पद को स्थायी रूप से भरा जा सकता है। उसके बाद यदि उस पद का मूल धारक किसी अपील अथवा पुनरावलोकन के परिणामस्वरूप सेवा में

पुनः प्रस्थापित कर दिया जावे तो उस कर्मचारी को किसी अन्य, स्थायी रूप से रिक्त पद पर, समायोजित किया जाना चाहिये। यदि ऐसा कोई रिक्त पद नहीं हो तो उसके लिये एक अधिसंख्य (Supernumerary) पद उसी वेतन में सृजित करा कर कर्मचारी को समायोजित कर देना चाहिये तथा जैसे ही उसके संवर्ग अथवा श्रेणी में कोई नियमित स्थायी पद रिक्त हो जाय तो अधिसंख्य पद समाप्त कर दिया जाय।राज्य सरकार का यह निर्णय है कि राजस्थान सेवा नियमों का नियम   54 अपने आप में एक पूर्ण (Absolute) नियम है तथा उसके अपने अधिकार-क्षेत्र पर कोई प्रतिबंध नहीं है। जिन मामलों में एक कर्मचारी अपील पर बहाल कर दिया जाय तथा निलम्बन अवधि को बकाया अवकाशों के रूप में बदल दिया जाय तथा पुनः प्रस्थापन करने पर कर्मचारी को स्थायी पद पर पदाधिकार नहीं दिया जा सके तो भी सेवा में पुनः प्रस्थापित किये गये ऐसे कर्मचारी को पदाधिकार देने तथा उसे उस अवधि का अवकाश वेतन एवं भत्ते आदि देने के लिये किसी अतिरिक्त पद के अथवा अधिसंख्य पद के सृजित किये जाने की आवश्यकता नहीं होनी चाहिये। इस परिस्थितियों में ऐसे कर्मचारी का वेतन एवं भत्ते आदि सेवा नियम 54 के अनुसार किसी अधिसंख्य पद के बिना भी भुगतान किये जा सकते हैं क्योंकि ऐसी परिस्थिति में वेतन आदि चुकाने को स्वीकार्य अतिरेक (Permissible) माना जाता है।

Rajasthan Service Rule 54 -- Re-instatement— (1) When a Government servant who has been dismissed, removed, compulsorily retired or suspended is re-instated or would have been re-instated but for his retirement on superannuation while under suspension, the authority competent to order the re-instatement shall consider and make a specific order:— (a) regarding the pay and allowances to be paid to the Government servant for the period of his absence from duty or for the period of suspension ending with the date of his retirement on superannuation as the case may be; and (b) Whether or not the said period shall be treated as a period spend on duty.

(2) Where such competent authority holds that the Government Servant has been fully exonerated or, in the case of suspension that it was wholly unjustified, the Government servant shall be given the full pay and dearness allowance to which he would have been entitled had he not been dismissed, removed or compulsorily retired as a penalty or suspended, as the case may be.

(3) In other cases, the Government servant shall be given such proportion of such pay and dearness allowance as such competent authority may prescribe.

(4) In a case falling under clause (2) the period of absence from duty shall be treated as a period spent on duty for all purposes.

(5) In a case falling under clause (3) the period of absence from duty shall not be treated as a period on duty unless such authority specifically directs that it shall be so treated for any specified purpose:

Provided that if the Government so desires, such authority may direct that the period of absence from duty shall be converted into leave of any kind due and admissible to the Government servant.

Note:- The order of the compentent authority regarding the treatment of the period of absence from duty passed under this proviso is absolute and no higher sanction would be necessary for the grant of extra-ordinary leave in excess of three months in so far as temporary Government servant are concerned. #

(6) In cases where punishment order does not indicate as to whether the suspension period is to be counted for the purpose of pension or not, the period of suspension shall be counted for the purpose of pension. In all other cases action shall be taken as per punishment order.

 (7) Any payment made under this rule to a Government servant on his reinstatement shall be subject to adjustment of the amount, if any, earned by him through an employment, business, profession or vocation during the period between the date of removal, dismissal or compulsory retirement, as the case may be, and the date of reinstatement. Where the emoluments admissible under this rule are equal to or less than the amounts earned during the employment, business, profession or vocation elsewhere, nothing shall be paid to the Government servant.

For Administrative Instructions Issued By The Government See appendix I, Section II, Suspension During Pendency Of Criminal Proceeding For Arrest For Debts Or During Detention Under a Law Providing For Prevention Detention.

NOTES. 1. The revising or appellate authority is competent to convert the period spent under suspension into one of leave and direct the payment of the appropriate leave salary.

2. If a Government servant who is dismissed or removed from service is reinstated on appeal with effect from a subsequent date and the interval between days of dismissal or removal and reinstatement is ordered to be treated as spent on duty and allowed to count for leave and increments such orders should have effect even though during the period of unemployment the Government servant had no lien on a permanent post. Consequently posts vacated by Government servants who are dismissed or removed from Government service may be filled substantively subject to the condition that the arrangements thus made will be reversed if the dismissed Government servant is reinstated, on appeal.

 3. A question having arisen whether in cases where the period of suspension is ordered to be treated as one spent on leave and when on conversion it is found the greater part of the period is to be treated as extraordinary leave to which no leave salary is admissible the recovery of the subsistence allowance already paid would be in order, it has been decided that there is no bar to the conversion of any portion of a period of suspension into extra-ordinary leave. In the case of persons who are not fully exonerated, the conversion of the period of suspension into leave with or without allowance has the effect of removing the stigma of suspension and all the adverse consequence following therefrom. The moment the period of suspension is converted into leave, it has the effect of vacating the order of the suspension and it will be deemed not to have been passed at all. Therefore if it is found that the total amount of subsistence and compensatory allowance that an officer received during the period of suspension exceeds the amount of leave salary and allowance, the excess will have to be refunded and there is no escape from the conclusion.

 4. The grant of extra-ordinary leave and dismissal from Government service are entirely different matters and the analogy of the treatment accorded by conversion of suspension period into leave does not automatically apply to cases of dismissal with retrospective effect as the latter has the effect of removal of the Government servant from his post. An allowance granted for the maintenance of the Government servant during the interim period should not therefore, be recovered from him.

5. A permanent post vacated by the dismissal, removal or compulsory retirement of a Government servant should not be filled substantively until the expiry of the period of one year from the date of such dismissal, removal or compulsory retirement, as the case may be. Where, on the expiry of the period of one year, the permanent post is filled and original incumbent of the post is reinstated thereafter, he should be accommodated against any post which may be substantively vacant in the grade to which his previous substantive post belonged. If there is no such vacant post, he should be accommodated against a supernumerary post which should be created in this grade with proper sanction and with the stipulation that it would be terminated on the occurrence, of the first substantive vacancy in the grade.

Government of Rajasthan's Decisions. 1. A case has arisen where the services of a Government servant were terminated on 6-3-57 and on appeal he was reinstated in service. The appellate authority declared that he may be granted leave due for the period from 6-3-57 to 30-6-57 and full pay of the post from 1-7-1957 onwards. The incumbent resumed his duties with effect from 16-12-1957. As there was no post against which lien of the Government servant could be shown for the period of dismissal as officiating arrangements had already been made against the post to carry on the work, a suggestion was made to create a post for providing him a lien and for enabling him to draw pay, allowances for the period. The matter has been examined and it is clarified that rule 54 of Rajasthan Service Rules is absolute and unconditional and that it could not be absolute if the condition of a 'lien' has first to be-satisfied. The pay and allowances to a Government servant under these circumstances are admissible under Rule 54 of Rajasthan Service Rules and the question of creating a post for this period therefore does not arise as this is a permissible excess. *

2 It has come to the notice of this Department that some officials have been producing copies of an order purporting to have been issued by the Finance Department (Rules) bearing No. FD/Rules/62/Gr.II/Gr.1/1 dated 11th November, 1974, dealing with the subject of reinstatement of suspended, persons in whose case the period of suspension has been considerably prolonged. The order so produced is quoted below:— "The Government of Rajasthan vide order No. F.1 (3)Apptts/AO/61 / Gr. III dated 7-2-62, No. F 2900/23/(l8)Apptts/A/58 dated 25th March. 1967 and No. D. 9968/F. 23/Apptts(A)/68 dated 21st August, 1968 have repeatedly desired that the Departmental Enquiry cases against the suspended employees should be given TOP PRIORITY/PERSONNEL ATTENTION to finalize the Departmental Enquiry cases within six months. But while going through the Annual Statements for the year 1973-74, it has been revealed that the aforesaid instructions in respect of suspended Government employees have not been strictly followed by the Heads of the Departments. It has been further observed that in some cases the Enquiry Officers have taken a lot of time to complete enquiry and in certain cases they have been found to be committing serious procedural irregularities in conducting D.E.'s this negligence causes further prolongation of the D.E. as well as suspension period, the Government have, therefore been pleased to order that:-

(1) In exceptional cases if any delinquent Govt. employee has continued under suspension for a period exceeding two years and he has not been prosecuted in a Court of Law the orders placing such employee under suspension be immediately withdrawn without prejudices to the decision to be taken in the Departmental Enquiry case. In case where a delay exceeding five years due to Criminal Proceeding pending against the delinquent suspended employee in a Court of Law, such suspension orders may also be withdrawn and he may ask to perform his duties at the same station on which was fixed by the Disciplinary Authority on the day he was placed under suspension. Such kind of action will not be affected adversely on his future men/promotion whichever is due. The decision as to how the period of suspension is to be treated in such a case action shall however be taken when the D.E./Court Proceedings against the delinquent is finally decided. Please note that Sessions Trial/criminal Appeal Cases pending against the delinquent in Upper Courts for the own acquittal shall not be considered for duty purpose till he has not been discharged by the Court.

(2). Where an appeal to the higher authority or as a result of Court Decision an appeal is accepted due to non-observation of the prescribed procedure either by the Enquiry Officer or the Disciplinary Authority Departmental action should invariably be taken against the enquiry officer/disciplinary authority. These orders should be brought to the notice of all disciplinary authorities for immediate compliance. No such order reproduced above bearing the number and date mentioned has been issued by Finance Department/Department of Personnel. It is, therefore, enjoined upon All Administrative Departments/Head of the Departments and Disciplinary Authorities that the said order should not be acted upon. In cases where action had already been taken on the basis of such fake document they should be re-opened and rectified and details intimated to this Department. It is also stressed that no action should be taken on the basis of copies of orders/circulars unless they are duly attested by responsible officers/officials. The receipt of this letter may kindly be acknowledged.
