अस्पताल अवकाश (नियम 105)

इस अवकाश के प्रारम्भ में राज्य सरकार ने निम्न दो टिप्पणियां दी है:-

1. यदि किसी कर्मचारी पर कर्मकार क्षतिपूर्ति अधिनियम,1923 लागू होता हो तो इन नियमों में भुगतान किये जाने वाले अवकाश वेतन की राशि उसको प्राप्त होने वाली क्षतिपूर्ति राशि में से काटी जायेगी जो उक्त अधिनियम के तहत उसे प्राप्त होगी।

2. इसी तरह यदि किसी कर्मचारी पर राज्य कर्मचारी क् बीमा अधिनियम, 1948 लागू होता हो तो इन नियमों में भुगतान किये जाने वाले अवकाश वेतन की राशि में से उक्त अधिनियम के तहत स्वीकार्य एवं देय लाभ की राशि को घटा दिया जायेगा।

नियम 105 के अनुसार सक्षम अधिकारी, एक ऐसे चतुर्थ श्रेणी कर्मचारी अथवा लिपिक वर्गीय अथवा अधीनस्थ सेवा के कर्मचारी को चिकित्सालय अवकाश स्वीकृत कर सकता है जिसका वेतन चिकित्सालय में प्रवेश के दिन ₹ 31000 मासिक (दिनांक 1 अक्टूबर 2017 से प्रभावी) से कम है एवं जिसका कार्य एवं उत्तरदयित्व विषम संयंत्रों, विस्फोटक सामग्री, विषैली औषधियों/रसायनों को हाथ से पकडने (Handle) करने का हो अथवा जो जोखिम का कार्य करता हो, और जब वह ऐसी बीमारी या घाव का उपचार करा रहा हो। उस कर्मचारी को बीमारी अथवा चोट/जख्म स्पष्टतया उस के पद के कर्तव्यों और जोखिमों के कारण होने चाहिये।

NOTES

1.—In the case of a person to whom the Workmen's Compensation Act, 1923 applies, the amount of leave salary payable under these rules shall be reduced by the amount of compensation payable under the said law.

2.—In the case of a person to whom the provisions of Employees' State Insurance Act, 1948 apply, leave salary payable under these rules shall be reduced by the amount of benefit admissible under the said Act for the corresponding period.

Extent of admissibility of Hospital Leave.—A competent authority may grant hospital leave to a Class IV Government servant and to such Ministerial and Subordinate Government servants whose pay at the time of admission to hospital is less than [Rs.31000/-] and whose duties involve handling of dangerous machineary, explosive materials, poisonous drugs etc. or the performance of hazarduous tasks, while under medical treatment for illness or injury if such illness or injury is directly due to risks incurred in the course of their official duties.
