सेवानिवृत्ति पर अन उपयोजित उपार्जित अवकाश के एवज में नगद भुगतान

(1) एक राज्य कर्मचारी के राजस्थान सिविल सेवा पेंशन नियम 1996 के नियम 50 एवं 53 के अनुसार अधिवार्षिकी असमर्थता  क्षतिपूरक पेंशन अथवा सेवा निवृत्ति पेंशन प्राप्त करने पर उसके उपार्जित अवकाश के लेखों में बकाया अवशेष 300 दिन से अनधिक के उपार्जित अवकाशों के एवज में उनके समान अवकाश वेतन की राशि उसे चुका दी जावेगी। वित्त विभाग की अधिसूचना क्रमांक:एफ1(12)12 वित्त/नियम /2005 दिनांक 17 नवंबर 2014 के अनुसार सेवानिवृत्ति पर समर्पित अवकाश के भुगतान की गणना आधे से कम दिन को शून्य तथा आधे या अधिक को एक दिन माना जायेगा।

(2) वित्त विभाग की अधिसूचना क्रमांक:एफ.1(5)वित्त/नियम/96दिनांक 20 अगस्त 2001 के अनुसार यह लाभ उन राज्य कर्मचारियों को दे नहीं है जिनको राजस्थान सिविल सेवाएं (वर्गीकरण,नियंत्रण एवं अपील) नियम,1958 के अंतर्गत शास्ति के रूप में अनिवार्य रूप से सेवानिवृत्त किया गया है।

(3) अनूपयोजित उपार्जित अवकाशों के एवज में नगद भुगतान एकमुश्त तथा एक ही समय, सेवानिवृत्ति के समय चुकाया जावेगा।

(4) इस नियम के अनुसार अनुपयोजित उपार्जित अवकाशों के एवज में अवकाश वेतन की फलावट कर्मचारी की सेवानिवृत्ति के दिन वेतन की दर तथा उसी दिन महंगाई भत्ते की प्रभावी दर के अनुसार दी जावेगी जिसके साथ अन्य कोई क्षतिपूर्ति भत्ता या मकान किराया भत्ता नहीं दिया जावेगा।

(5) कार्यालय अध्यक्ष तथा विभाग अध्यक्ष, जैसी भी स्थिति हो,इस प्रकार के अनूपयोजित उपार्जित अवकाशों के एवज में नगद भुगतान की स्वीकृति देने को सक्षम माने जाएंगे जिनकी 300 दिन की अधिकतम सीमा होगी।राज्य सरकार ने यह निर्णय लिया है कि सक्षम प्राधिकारी संबंधित सरकारी कर्मचारी से आवेदन पत्र प्राप्त करने पर सेवानिवृत्ति की तारीख से 1 माह पूर्व अग्रिम में नगद भुगतान के लिए आदेश जारी कर सकेगा लेकिन इसका भुगतान सरकारी कर्मचारी की वास्तविक सेवानिवृत्ति के प्रभावी होने के बाद ही किया जाएगा।नगद भुगतान स्वीकृत करने एवं वास्तविक सेवानिवृत्ति की तारीख से उस अवधि के दौरान साधारणतया उसे कोई उपार्जित अवकाश स्वीकृत नहीं किया जाएगा।विशेष परिस्थितियों में यदि कोई अवकाश स्वीकृत करने की जरूरत हो तो नगद भुगतान के लिए पूर्व में जारी किए गए आदेश उनको भी सक्षम प्राधिकारी द्वारा साथ साथ संशोधित किया जाना चाहिए।

(6) जिन कर्मचारियों की अधिवार्षिकी की आयु के बाद सेवा में अभिवृद्धि करके आगे रखा जाता है उन्हें भी अनुपयोगी उपार्जित अवकाशों  के एवज में एकमुश्त नगद भुगतान उनकी सेवा वृद्धि की समाप्ति पर अंतिम रूप से सेवानिवृत्त किए जाने पर प्राप्त हो सकेगा।

(7) ऐसे मामलों में अवकाश स्वीकृत करने में सक्षम प्राधिकारी ऐसे सरकारी कर्मचारी के उपार्जित अवकाश की संपूर्ण या आंशिक नगद राशि को रोक सकेगा जो निलंबन के अधीन रहते हुए या उसके विरुद्ध अनुशासनिक या अपराधीक कार्यवाही के लंबित रहते हुए अधिवार्षिकी आयु प्राप्त करने के कारण राज्य सेवा से सेवानिवृत्त हो गया था।सक्षम प्राधिकारी ऐसा तभी कर सकेगा जब उसके विरुद्ध कार्यवाही के समाप्त होने पर उससे कुछ राशि वसूली योग्य होने की संभावना हो। कार्यवाही के संपन्न हो जाने पर सरकारी बकायों का समायोजन करने के बाद, यदि कोई हो,इस प्रकार रोकी गई धनराशि प्राप्त करने के लिए वह सरकारी कर्मचारी पात्र हो जाएगा।

Cash payment in lieu of unutilised privilege leave on the date of retirement—

(1). A Government servant on retirement from service on superannuation, invaild, compensation pension or retirement pension under rule 50 and 53 of Rajasthan Civil Services (Pension) Rules, 1996 shall be paid cash equivalent to leave salary in respect of the period of unutilised privilege leave not exceeding 300 days at his/her credit at the time of retirement.

Note : The benefit under this sub-rule shall not be admissible to the Government servants retired compulsorily as a measure of penalty under the Rajasthan Civil Services (CC&A) Rules, 1958.

(2) The cash payment of leave salary admissible under sub-rule (1) above shall be paid on retirement in one lump sum as one time settlement.

(3) The cash payment under this rule shall be equal to leave salary as admissible for privilege leave and dearness allowance admissible on that leave salary at the rates in force on the date of retirement. No City Compensatory Allowance or House Rent Allowance shall be payable on cash payment of leave salary.

(4) The head of office or head of department, as the case may be, shall be competent to grant leave and permit cash equivalent of privilege leave not exceeding 300 days at the credit of a Government servant on the date of retirement.

(5) The benefit of cash payment under this rule, shall also be admissible to Government servants who are granted extension in service after attaining the age of superannuation. In such cases the benefit shall be granted on the date of final retirement on the expiry of extension.

(6) The authority competent to grant leave may withhold whole or part of cash equivalent of privileage leave in case of a Government servant who retired from service on attaining the age of retirement while under suspension or while disciplinary or criminal proceedings are pending against him, if in the view of such authority there is a possiblility of some money becoming recoverable from him on conclusion of the proceedings against him. On conclusion of the proceedings, he will become eligible to the amount so withheld after adjustment of the Government dues if any.

Note- In order to avoid delay in getting cash payment in lieu of balance of unutilised provilege leave on retirement, it has been decided that the competent authority may issue orders for cash payment one month in advance of the date of retirement on receipt of application from the concerned Governemnt servant but the payment of the same can be made on the date of retirement of the Government servant. During the period, from the date of sanctioning cash payment and actual retirement ordinarily no privilege leave shall be sanctioned to him. If in emergent circumstances any leave is required to be sanctioned the orders earlier issued for cash payment shall be simultaneously revised by the leave sanctioning authority.

Note-(a) In the event of death of a Government servant while in service, a lump-sum amount equal to the amount of leave salary admissible under Rule 97 and dearness allowance admissible thereon in respect of privileage leave that may be due to the deceased Governement servant on the date of death not exceeding = "300 days" privileage leave may be paid to the widow/children of the deceased Government servant. The method of calculation of cash payment shall be as prescribed in sub-rule (4) of rule 91B.

(b) The authority competent to sanction family pension in respect of deceased Government servant shall sanction the lumpsum amount payable under this rule.
