निलम्बित राज्य कर्मचारी को निर्वाह अनुदानः एक निलम्बित राज्य कर्मचारी को निर्वाह अनुदान के रूप में निम्नांकित भुगतान प्राप्त हो सकते है :
1. नियम 53(1)(क) के अनुसार निलम्बन के प्रथम 6 माह की अवधि में उसे अर्द्ध-वेतन अवकाश के समान वेतन एवं उस पर देय मंहगाई भत्ता, निर्वाह अनुदान के रूप में दिया जावेगा।
2. जहां निलम्बन की अवधि 6 माह से अधिक हो तो वह अधिकारी जिसने कर्मचारी के निलम्बन की आज्ञा जारी की हो या उसके द्वारा दी गयी हो तो वह 6 माह से कितने भी अधिक समय लिये निर्वाह भत्ते की राशि में निम्न परिवर्तन कर सकता है-
(अ) नियम 53(1)(क)(i) के अनुसार जहाँ निलम्बन की अवधि 6 माह से अधिक हो जाए और सक्षम प्राधिकारी लेखबद्ध कारणों के आधार पर इस परिणाम पर पहुँचे कि 6 माह से अधिक की अवधि प्रत्यक्ष रूप से कर्मचारी के कारण नहीं बढ़ाई गई है तो कर्मचारी को प्रथम 6 माह की अवधि में दिये गये निर्वाह अनुदान की राशि में 50% तक की वृद्धि की जा सकती है।
(ब) नियम 53(1)(क)(ii) जहाँ निलम्बन की अवधि 6 माह के आगे प्रत्यक्ष रूप से कर्मचारी के व्यवहार के कारण बढ़ हो, वहाँ सक्षम प्राधिकारी, कर्मचारी को 6 माह में दिये गये निर्वाह अनुदान की राशि में से 50% तक की कमी कर सकता हैं। ऐसे
कारणों को आज्ञा में लेखबद्ध करने होंगें।
3. नियम 53(1)(क)(iii) के अनुसार मंहगाई भत्ते की दरें उपरोक्त तीनों स्थितियों में स्वीकृत वेतन की दर के आधार पर (बढ़ी-घटी हुई दर) जैसी स्थिति को, निर्धारित की जावेगी।
4. नियम 53(1)(ख) के अनुसार निलम्बित किये जाने के दिन यदि कर्मचारी को महंगाई भत्ते के अलावा कोई अन्य क्षतिपूरक भत्ते (Compensatory Allowances) प्राप्त हो रहे हों तो वह भी निलम्बित कर्मचारी को निर्वाह अनुदान की उक्त फलावट अतिरिक्त प्राप्त होंगे।
5. उक्त अनुच्छेद में 6 माह की अवधि, उस दिन से गिनी जावेगी जिस दिन कर्मचारी निलम्बित किया गया था।
Rajasthan Service Rule 53(1) -- Subsistence grant—
(1) A Government servant under suspension shall be entitled to the following payments, namely:--
(a) subsistence allowance at an amount equal to the leave salary which the Government servant would have drawn if he had been leave on half pay and in addition dearness allowance based on such leave salary: Provided that where the period of suspension exceeds [six months] the authority which made or is deemed to have made the order of suspension shall be competent to vary the amount of subsistence allowance for any period subsequent to the period of the first [six months] as follows:—
(i) the amount of subsistence allowance may be increased by a suitable amount, not exceeding to 50 percent of the subsistence allowance admissible during the period of .the first [six months] if, in the opinion of the said authority, the period of suspension has been prolonged for reasons to be recorded, in writing not directly, attributable to the Government servant;
(ii) the amount of subsistence allowance may be reduced by a suitable amount, not exceeding 50 percent of the subsistence allowance admissible during the period of the first [six months] if, in the opinion of the said authority, the period of suspension has been prolonged due to reasons, to be recorded in writing, directly attributable to the Government servant
(iii) the rate of dearness allowance will be based on the increased or, as the case may be the decreased amount of subsistence allowance admissible under sub clause (i) and (ii) above.
(b) Any other compensatory allowances admissible from time to time on the basis of pay which the Government servant was in receipt on the date of suspension subject to the fulfillment of other conditions laid down for the drawal of such allowances.
Clarification A question has been raised whether the period of twelve months mentioned in the proviso to rule 53(1) (a) of the Rajasthan Service Rules is to be calculated from the date of issue of the Finance Department Notification of even number dated 22-1-1964 or from the date on which a Government servant was placed under suspension by the competent authority.
The matter has been examined and it is clarified that the period of twelve months referred to in the aforesaid rule shall be reckoned from the date on which a Government servant was placed on suspension.
(2) No payment under sub-rule (1) shall be made unless the Government servant furnishes a certificate, that he is not engaged in any other employment, business, profession or vocation :
Provided that in the case of a Government servant dismissed, removed or compulsorily retired from service, who is deemed to have been placed or to continue to be under suspension from the date of such dismissal or removal or compulsory retirement under sub-rule (3) or sub-rule (4) of Rule 13 of the Rajasthan Civil Services (Classification, Control and Appeal) Rules, 1958 and who fails to produce such a certificate for any period or periods during which he is deemed to be placed or to continue to be under suspension, he shall be entitled to the subsistence allowance and other allowances equal to the amount by which earnings during such period or periods as the case may be, fall short of the amount of subsistence allowance and other allowances that would otherwise be admissible to him; where the subsistence allowance and other allowances admissible to are equal to or less than the amount earned by him, nothing in this proviso shall apply to him.
Clarification. A case has come to the notice of the Government in which a Government servant under suspension left his headquarters without obtaining prior permission of the competent authority. The suspending authority there upon stopped payment of subsistence allowance to the Government servant concerned. The matter has been considered and it is clarified that the suspending authority has no discretion to stop payment of subsistence allowance. A Government servant under suspension has to be paid subsistence allowance during suspension period. The competent authority may however initiate another enquiry under provisions of the Rajasthan Civil Services (Classification, Control & Appeal) Rules, 1958 against suspended Government servant concerned who has left the headquarters without permission of the compentent authority.
