निलम्बन काल में अवकाश स्वीकृति का निषेध : नियम 55 के अनुसार निलम्बन काल में किसी राज्य कर्मचारी को कोई अवकाश स्वीकृत नहीं किया जा सकता है।

यद्यपि नियम 55 के अनुसार निलम्बन काल में राज्य कर्मचारी को किसी प्रकार के अवकाश देने पर प्रतिबन्ध है अपितु राज्य सरकार का यह निर्णय है कि यदि निलम्बित कर्मचारी को उसके परिवार में गंभीर बीमारी के कारण कठिनाई होती हो तो ऐसे मामले में सक्षम प्राधिकारी द्वारा कर्मचारी को मुख्यालय छोड़ने की अनुमति दी जा सकती है जो अत्यंत आवश्यक परिस्थितियों तथा जाँच की स्थिति एवं राज्य कर्मचारी की अनुपस्थिति के कारण जाँच की प्रगति में संभावित प्रभावों/परिणामों को ध्यान में रखकर उचित समय के लिये दी जावेगी।

राज्य सरकार का स्पष्टीकरण है कि एक   निलम्बित कर्मचारी को मुख्यालय पर अपनी उपस्थिति सिद्ध करने के लिये नियमित रूप से कार्यालय में उपस्थित होना चाहिये यदि सक्षम प्राधिकारी ऐसा न चाहे तो उस कर्मचारी को कार्यालय में उपस्थिति अंकित करना आवश्यक नहीं होगा।

नियम 55A के अनुसार ऐसे राज्य कर्मचारी को किसी प्रकार का अवकाश स्वीकत नहीं किया जावेगा जिसे दण्ड देने वाले सक्षम प्राधिकारी ने राज्य सेवा से बर्खास्त करने अथवा निष्कासित करने अथवा अनिवार्य सेवा-निवृत्त करने का निर्णय कर लिया है।

Government of Rajasthan's Decision

Under Article 55 of Rajasthan Service Rules restriction has been imposed on grant of leave to a Government servant under suspension. Application of this rule, however, causes hardship in the event of serious illness-in the family. etc His Highness the Rajpramukh has therefore, been pleased to order that permission to leave headquarters may be given in such cases by the authority competent to fill the post; for reasonable periods in unavoidable circumstances, keeping in view the state of the enquiry and the possible effect of Government servant's absence on its progress.

 Clarification

According to Rule 55 of Rajasthan Service Rules leave cannot be granted to a suspended Government servant, however, in the event of illness of a family member etc. permission to leave headquarters can be given by the competent authority. A question has been raised whether a suspended Government servant should attend office regularly to prove his presence at the headquarters. The matter has been examined and it is clarified that a suspended Government servant should regularly attend office unless it is not so desired by the competent authority .

55-A. Leave shall not be granted to a Government servant whom a competent punishing authority has decided to dismiss, remove or compulsorily retire from Government service.
