अवकाश अधिकार के रूप में नहीं मांगे जा सकते हैं : नियम 59

अवकाश अधिकार के रूप में नहीं मांगे जा सकते हैं : नियम 59 के अनुसार कर्मचारी अवकाश को अधिकार के रूप में नहीं मांग सकता। अवकाश स्वीकृतिकर्ता प्राधिकारी को यह विवेकाधिकार होगा कि वह जनहित में, आवेदित अवकाश को अस्वीकार कर दे, कम समय का स्वीकार कर दें, अथवा स्वीकत अवकाश को किसी भी समय निरस्त/खण्डित कर दे।

अवकाश स्वीकृति कर्त्ता जनहित में अथवा कार्य संचालन की दृष्टि से किसी कर्मचारी द्वारा आवेदित अवकाश को अस्वीकृत करने अथवा पूर्व में स्वीकृत किये गये अवकाश को निरस्त करने का पूर्ण विवेकाधिकार रखता है किन्तु उसे आवेदित एवं देय अवकाश की प्रकृति (Nature) परिवर्तित करने का अधिकार नहीं हैं।

इस नियम के अर्न्तगत अवकाश स्वीकृतकर्ता प्राधिकारी को राज्य कर्मचारी द्वारा उसकी इच्छानुसार उपार्जित अवकाश या अर्द्ध-वेतन अवकाश के लिये आवेदन किये गये विकल्प में हस्ताक्षेप का कोई अधिकार नहीं है। राजस्थान सरकार का आदेश है कि जहाँ सक्षम प्राधिकारी को ऐसा प्रतीत हो कि कोई कर्मचारी अवकाश नियमों के

अवांछित लाभ की चेष्टा कर रहा है अथवा उन नियमों का आशय गलत ढंग से लगाकर लाभ उठाना चाहता है तो अवकाश स्वीकृतिकर्ता प्राधिकारी, सेवा नियम 59 के अंतर्गत उसे प्रदत्त विवेकाधिकारों का उपयोग करके, ऐसे अवांछित लाभ उठाने अथवा गलत ढंग से लाभ प्राप्त करने की चेष्टा को चाहे गये अवकाश को अस्वीकृत करके रोक सकता हैं।

स्वीकृत एवं उपभोग किये अवकाश की प्रकृति बदलने की कर्मचारी को सुविधा : राजस्थान सरकार का यह आदेश भी है कि एक राज्य कर्मचारी जिसे पूर्व में किसी एक प्रकार का अवकाश स्वीकृत कर दिया गया हो तो उसके निवेदन करने पर उस अवकाश की प्रकृति बदलने की स्वीकृति, पूर्व प्रभाव से दी जा सकती है यदि ऐसा अवकाश उसे प्रारम्भ में ही शेष एवं देय था तथा कर्मचारी द्वारा अवकाश की प्रकृति को बदलने का आवेदन-पत्र, पूर्व में स्वीकृत अवकाश की समाप्ति के 3 माह में सक्षम प्राधिकारी को प्राप्त हो गया हो। ऐसे मामले में अवकाश की प्रकृति बदलने पर यह प्रकट हो तो कि अवकाश वेतन के रूप में राशि का अधिक भुगतान हो गया है तो उसकी वसूली की जावेगी तथा अवकाश की प्रकृति में परिवर्तन के कारण कोई राशि कर्मचारी को देय बनती हो तो उसका भुगतान किया जावेगा।

Rajasthan service rule 59 -- Leave cannot be claimed as right— Leave cannot be claimed as a right. Discreation is reserved to the authority empowered to grant leave to refuse or revoke leave at any time according to the exigencies of the public service; provided that any leave applied for and due as preparatory to retirement shall not be refused by such authority and it shall be refused in writing by the Government or by such authority to whom powers have been delegated in this behalf. The nature of leave due and applied for by a Government servant cannot be altered at the option of the sanctioning authority, and so while it is open to the authority competent to refuse or revoke leave due and applied for under this rule, it is not open to him to alter the nature of such leave.

Government of Rajasthan's Orders. 1-Instances have come to notice of late where the interval of duty between two or more spells of leave availed of by the Government servants was only nominal. In such cases, the leave sanctioning authorities failed to check the attempt at evasion of leave rules by exercising their discretion under Rule 59 of Rajasthan Services Rule to refuse leave and granted the leave ignoring the spirit of the rules with the result that unintended benefit were derived by the Government servants concerned.{Inserted vide FD Memo No, 2834/F.7A (21)FD-A (Rules)/58, dated 7-2-1959.}

2. Under Rule 59 of Rajasthan Service Rules an authority empowered to grant leave has no power to interfere with the option admissible to a Government servant to take privilege leave or half pay leave as he may elect. Thus once leave is sanctioned, its nature cannot be altered by treating two separate spells of leave as a continuous one so as to obviate any unintended benefit being derived from the rules. The deliberate or intentional evasion of leave rules can, however, be checked by the leave sanctioning authorities by resort to refusal of leave under Rule 59 of R. S. R. as the case may be. It is, therefore, suggested that action may be taken to ensure that all cases in which a fresh spell of leave is applied for by Government servants after a short interval of duty, are carefully examined with a view to see that the spirit of the rules is observed and that the competent authorities refuse the leave by exercising the discretion vested in them under Rule 59 of R. S. R., if they have reason to believe that an attempt was being made to take undue advantage of the leave rules or to evade the spirit thereof.

3. Requests are being received in Finance Department from the Administrative Department/Heads of Departments that one kind of leave sanctioned to the Government servants be converted into another kind of leave. The matter has been considered and the Governor has been pleased to order that in such a case the authority which granted him leave may commute it retrospectively into leave which was due and admissible to him at the time of leave was granted, provided that the request for commutation is received within a period of 3 months of the expiry of the said leave. It is further ordered that the commutation of one kind of leave into another shall be subject to adjustment of leave salary on the basis of leave finally granted to the Government servants i.e. any amount paid to him in excess shall be recovered or any arrears due to him shall be paid.{Inserted vide F.D.
